For the purposes of this policy, the “Quantum Group” includes the entities Quantum Juricomptable Inc., Alias, Ligne de signalement inc. and Enquêtes LRG Inc. as well as any other company that may be added to the Quantum Group in the coming years (“we“, “us“).

The Quantum Group attaches particular importance to privacy and the protection of personal information. This Privacy Policy (the “Policy“) describes our data protection practices, the types of Personal Information we may receive or collect from you and how we use, disclose, store, and protect it (collectively, the “Processing” or “Process“, including its conjugated versions). In order to provide you with quality services, we need access to certain Personal Information about you. Our employees handle this information with the utmost discretion and rigour, and in compliance with applicable legal and regulatory requirements.

1. REGARDING THIS POLICY

This Policy applies to the provision of our reporting line service and our ALIAS™ reporting platform (collectively, the “Platform“) and any other product or service offered by the Quantum Group. It also describes why and how we Process your Personal Information when you visit the Quantum Group websites (quantumjuricomptable.com, aliassolution.com et enqueteslrg.com, collectively the “Website“), including through the use of Cookies, as defined below. For more information on this subject, please see the section “10”. In most cases, when you use the Platform, we act as a processor and we Process your Personal Information according to the instructions received from our customers. When Quantum Group Processes your Personal Information obtained from the Website, it acts as a controller of those Personal Information.

2. WHAT IS PERSONAL INFORMATION?

For the purposes of this Policy, we define “Personal Information” as any information about an identifiable individual, including information that can be used alone or can be combined with other information to identify, contact, or locate a single individual, directly or indirectly. Depending on the applicable law, Personal Information may or may not include your business contact information, such as your name, your title, or your work contact information.

3. PRIVACY PROGRAM

In order to protect your Personal Information, we have implemented policies, practices and procedures relating to the management of the Personal Information we hold. The collection of Personal Information through our Website and Platform complies with the requirements of this program.

4. WHICH PERSONAL INFORMATION DO WE COLLECT?

The Personal Information collected may include, but is not limited to:

  • Your contact details, such as a name, e-mail address or telephone number, when using the Website;
  • Your age, when using the Platform;
  • Your login details, such as a username and password, when using the Platform;
  • Some information concerning your professional status, such as your title or position in the business you work for, the name of that business and information about the situation you are reporting, when using the Platform;
  • Some information concerning your previous employment, such as your Curriculum Vitae, when you use the Website and apply for a job;
  • Some information concerning your marketing and communication preferences, such as comments or survey responses, when you use the Website;
  • Some information relating to the use of our Website or Platform, including technical information about visits or other information collected through cookies or other similar tools. This information includes, but is not limited to:
    • The number of visits to the Website and Platform;
    • The conversion rate of the Website;
    • The average length of your visit to the Website and Platform;
    • The date and time of your visit to the Website;
    • Actions taken on our Platform or Website;
    • The pages viewed during your visit to the Website and Platform;
    • The type of device used during your visit to the Website;
    • The web browser used during your visit to the Website;
    • The IP address used during your visit to the Website and the Platform;
    • The origin of visitors, i.e., the web page you visited before being redirected to our Website;
    • The advertising campaign that brought you to our Website;
    • Any other Personal Information provided.

5. WHY WE COLLECT AND USE YOUR PERSONAL INFORMATION?

5.1. For Specific and Limited Purposes

Personal Information collected by Quantum Group shall be used for the following purposes:

  • To establish and manage our relation with you, when you use the Website or the Platform (e.g., to collect voluntary disclosures from individuals on behalf of our customers);
  • To provide and maintain the Platform and our Website when you use the Website or Platform;
  • For research and development or statistical purposes and to improve the use of our Website and your browsing experience when using the Website or Platform;
  • To respond to your requests for information when you use our Platform or Website;
  • Analyze, develop, manage, protect and improve professional services;
  • To respond to your requests for support when using our Platform or Website;
  • Provide professional services to customers for the processing of a report;
  • To enable business development and marketing, including informing our current and future customers about our new offerings, with your prior consent, when you use our Website;
  • As permitted or required by any applicable legal or regulatory obligation or provision when you use our Website or Platform;

(collectively, the “Purposes“).

If we wish to use your Personal Information for a purpose not mentioned above and for which you have not consented, we will ensure that we seek appropriate consent from you or inform you of the change, where permitted by law.

6. HOW DO WE COLLECT YOUR PERSONAL INFORMATION?

Quantum Group primarily collects your Personal Information from you, but also from third parties or by means of Cookies or pixels, when you use the Website or the Platform.

6.1. Directly from the user

In general, we collect the Personal Information we need directly from the user. This collection of Personal Information occurs when the user wishes to obtain a product or service offered by Quantum Group or when a user communicates with Quantum Group, regardless of the means used (in person, by telephone, video conference, e-mail or through the Website).

Other situations may lead to the collection of information about a user or a third party, such as during an investigation or the processing of a report, in accordance with applicable privacy laws.

6.2. When using Quantum Group Products and Services

Quantum Group may also collect information that is generated by your mobile and/or computing devices (e.g., mobile advertising identifiers, location information and IP address). For more information, please see “How Do we Offer Online Advertising?“.

6.3. From Other Sources

Depending on the situation and in accordance with applicable privacy laws, Quantum Group may need to collect a user’s information from other individuals, organizations or entities.

6.4. With the User’s Consent

The legal basis for the Processing of your Personal Information is generally consent, unless the applicable law provides another permissible legal basis (for example, to comply with our legal obligations, where necessary to establish, exercise or defend a legal claim or legal proceeding or in accordance with our contracts).

6.5. With the Chat Tool

We offer you the opportunity to chat with us on our Website when you have questions. These chat services, provided by Facebook Messenger and LinkedIn Messaging, may, from time to time, request and collect information about you, including when you log into these services. This information establishes your identity and also allows you to benefit from the services that are available through this tool. Please note that your use of the chat tools is subject to the privacy policy and terms of use of Facebook and LinkedIn for which you are responsible to acknowledge.

6.6. Rejecting the Collection and Withdrawing Your Consent

You have the right, if you wish, to refuse the Processing of your Personal Information. You may also, at any time, and subject to reasonable notice and any applicable legal or contractual restrictions, withdraw your consent (if any) to the Processing of your Personal Information in our possession by contacting us. You should be aware, however, that if you choose not to provide your Personal Information, this may prevent you from, for example, using certain features of the Platform or the Website, as this information is sometimes essential to the provision of the Quantum Group’s service. To submit any requests in this regard, please use the information included in the “Contact Us” section of this Policy.

7. WITH WHOM do WE SHARE YOUR PERSONAL INFORMATION?

Alias does not rent or sell any of your Personal Information to third parties and will not share it with third parties without your consent, unless required by law or necessary for the Purposes set out above.

7.1. With our Employees and Consultants

Access to information is limited to Quantum Group employees and consultants who need it to perform their work, for example, when you contact us or request technical support for the Website or the Platform. Their access is limited to what is necessary for the performance of their duties.

7.2. With Customers, Strategic Partners or Service Providers

Quantum Group may share your Personal Information with a customer when you use the Platform and the sharing is necessary to fulfill the Purposes. Our customers agree not to use your Personal Information for any other purpose, including promotional purposes. 

Quantum Group may also use third parties, such as professionals, to facilitate its activities, such as when you use the Platform to make a report. As part of these activities, Quantum Group’ service providers may have access to your Personal Information for a limited time. When Quantum Group hires third parties to Process any Personal Information, Quantum Group implements reasonable contractual and technical safeguards to ensure that those third parties keep all Personal Information they Process strictly confidential. Please note that these third parties may be located at locations other than your location, in which case appropriate measures are taken by Quantum Group as set out below in the section “Where Is your Personal Information Hosted and Transferred?”.

7.3. When Required by Applicable Law

Quantum Group may also share your Personal Information if required to do so by law or if, in good faith, it believes that such action is necessary to: (i) comply with the law; (ii) comply with an order of a competent judicial authority, regardless of jurisdiction; (iii) comply with any legal process served on Quantum Group; (iv) protect and defend the rights or property of Quantum Group; (v) enforce or verify your compliance with agreements with Quantum Group, if any; (vi) prevent fraud or other illegal activity perpetrated through the Platform or the Website; or (vii) act in urgent circumstances to protect the personal safety of users of the Website, the Platform, or the general public.

7.4. In the Event of a Business Transfer

We may share your Personal Information without your consent when our operations require it (for example, in the event of a merger, an acquisition, a bankruptcy or a sale of assets).

In such circumstances, we limit sharing to what is necessary to assess the feasibility or advisability of the transaction.

8. HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?

8.1.  Personal Information Processed When You Use the Platform

The length of time we retain your Personal Information, when you use our Platform to report, is determined by our customer, the company that provided you with the Platform. Thus, this Personal Information will only be retained on our Platform for as long as required by the retention calendar established by the customer. If you would like more information on this subject, we invite you to contact our customer with whom you do business directly.

8.2. Personal Information from Your Interaction with the Website or Our Services

When you visit our Website or subscribe to our services, we will retain your Personal Information only for as long as necessary to fulfill the Purposes for which it was collected or to comply with applicable legislative, tax or regulatory requirements. Personal Information held by Quantum Group from your interaction with the Website will then be destroyed, deleted, or made anonymous. If you would like more information on this subject, please contact us using the information provided in the “Contact Us” section. Personal and business information is not retained indefinitely. Collected information will be destroyed, erased or disposed of in accordance with the retention period established by the Quantum Group, which complies with applicable privacy laws.

9. HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

9.1. With Necessary and Appropriate Security Measures

Quantum Group has security measures in place to protect your Personal Information. The safeguards we employ depend on the type of information collected. Our employees and suppliers are informed of the confidential nature of the Personal Information collected and are made aware of the appropriate security measures to prevent unauthorized access to Personal Information. Quantum Group employs physical, electronic, and procedural safeguards that comply with applicable regulations to protect your Personal Information. More precisely, Quantum Group meets the requirements of the ISO 27001 information security standard. If you have any questions about the security of your interaction with us (if, for example, you believe that the security of any account you may have with us has been compromised), you may contact us as set forth in the “Contact Us” section.

9.2. Children’s Privacy

The Website and the Platform are designed for people aged 13 years or older. Quantum Group does not knowingly Process Personal Information from children under the age of 13. If you believe that Personal Information has been collected from children under the age of 13, or if you are a parent or legal guardian and believe that your child under the age of 13 has provided us with Personal Information, you may contact us as described in the “Contact Us” section.

10. HOW DO WE USE COOKIES?

As mentioned above, we may use various tools to enhance your experience on our Website and Platform, in order to better understand our customers’ behaviour. The following sections are intended to give you more information about how we use these tools and how we carry out profiling, if at all.

A Cookie is a small text file that is stored in a dedicated location on your computer, mobile device, tablet or other device when you use your browser to visit an online service. Other tracking technologies, such as web beacons and tracking pixels, may be used for similar purposes. In this Policy, all such tracking technologies are collectively referred to as “Cookie(s)“. Any Personal Information collected using Cookies by, or on behalf of, Quantum Group is treated with the same level of confidentiality as any other Personal Information held by Quantum Group.

10.1. Necessary Cookies

These Cookies are necessary and essential to the operation of the Website and the Platform and cannot be disabled in our systems. Strictly necessary Cookies must be present in order for the Website or the Platform to provide basic functionality. They also allow a user to navigate from one page to another without losing previous actions from the same session.

10.2. Other Cookies

Quantum Group also uses other types of Cookies in connection with the Website and Platform, which have different functions:

  • Performance Cookies. These Cookies allow us to understand how you use the Platform in order to improve its performance. These Cookies provide information about usage patterns and trends that can be used for business analysis, for improvements of the Platform as well as establishing performance measures.
  • Functionality or Selection Cookies. These Cookies allow us to remember the choices you make when browsing the Platform.
  • Social Networking Cookies. These Cookies allow you, if you have an account with certain social networks, to share and like certain content directly from our Website. For example, articles, photos, and videos you view on our Website can be shared and liked via social networks using the share buttons. These Cookies are used to make these buttons work, so they will recognize you when you want to share these items.
  • Advertising Cookies. These Cookies collect information about your devices in order to display ads based on relevant topics that may be of interest to you. Similarly, our partners may use these Cookies to determine whether our advertisements have been displayed to you and whether you have interacted with them. In this case, our partners share data with us, including statistics on the performance of our ads. We may use Analytical Cookies to better understand traffic patterns on the Website, to help us measure and improve the effectiveness of the Website, and to determine whether our e-mails have been opened and links clicked. These Cookies are used for statistical purposes only. All information that these Cookies collect are aggregated and anonymous. Quantum Group uses Google Analytics, which is provided by Google Inc. 10.3. How to Manage Cookies?

With the exception of strictly necessary Cookies, nonessential Cookies can be managed and/or disabled via your browser’s Cookie settings and your mobile device’s advertising settings. However, if you modify your browser settings to block all cookies (including essential cookies), you may not be able to access the Website or Platform or some of their components.

Cookie settings for the Website can be modified at any time, via the banner available for this purpose.

Social network Cookies (“plugins“) can also be managed by consulting the policies of the following networks (to the extent applicable):

11. HOW DO WE OFFER ONLINE ADVERTISING (TARGETED ADVERTISING)?

11.1. Using Cookies or Mobile Ad Tags

Quantum Group and its advertising partners may collect your Personal Information, in order to provide you with advertisements about goods and services as well as work with online advertising companies to present you with relevant and useful advertisements. This may include advertisements presented on our Website or the websites of other companies. This Personal Information is collected: (i) with social network Cookies and/or advertising Cookies, as described above in the section, “How Do We Use Cookies? ” (ii) directly from you when you complete a survey, fill out a questionnaire or consent to receive e-mails.

Based on your preferences on your mobile devices, Quantum Group and its advertising partners may also use your mobile advertising ID to target and measure the effectiveness of their advertising campaigns. In iOS, this identifier is called “IDFA” (“ID for Advertising”); in Android (“Google Play”), this identifier is called “AAID” (“Android Advertising ID”). You can access and reset your mobile advertising ID or limit its use through your mobile device settings.

Under no circumstances will we allow advertising to children where we know, the user is under 13 years of age.

Please note that even if you choose not to receive ads targeted to your interests, it will still be possible to see ads from Quantum Group. In this case, the ads will simply not be tailored to your actual needs and may be displayed more frequently. 11.2. Facebook Custom Audience

Quantum Group also uses Facebook’s Custom Audience feature to target advertising to the interests of its customers and potential customers. Please check your Facebook privacy settings if you wish to manage your advertising settings. Further information can be found here.

11.3. Social Media Features

Our Website includes social media features such as the LinkedIn and Facebook share buttons. If you use these features, they collect certain information about you, including the page you visit on our Website. Your interaction with these features is governed by the privacy policy of the company that provides the feature and not by this Policy.

12. WHERE IS YOUR PERSONAL INFORMATION HOSTED AND TRANSFERRED?

Personal Information is usually hosted in Canada, but Quantum Group may use suppliers or third parties located outside Canada.

 If Quantum Group needs to share personal information with these suppliers and third parties, Quantum Group will ensure that your Personal Information is adequately protected by appropriate technical, organizational, contractual, or other legal means. Where applicable, we conduct Privacy Impact Assessments prior to transferring Personal Information to another jurisdiction, such as outside Quebec. 13. WHAT ARE YOUR RIGHTS?

Depending on the applicable law, you may have the right to access or correct your Personal Information, the right to withdraw your consent (if any),  the right to restrict and object to Quantum Group’s use and Processing of your Personal Information, the right to obtain more information about the Processing of Personal Information, the right to refuse our promotional communications (where applicable) or the right to data portability. In other words, the right to receive a copy of all Personal Information Quantum Group holds about you in a structured, commonly used, and machine-readable format.

In order to exercise these rights, we invite you to contact our Privacy Officer in writing as set out in the “Contact Us” section below. We will handle your requests in accordance with the applicable law.

14. LINKS TO THIRD-PARTY WEBSITES

It is important to understand that this Policy does not apply to other third-party websites that may be accessed through links on our Website. We are not responsible for these third-party websites, their content or access to them. Therefore, any Personal Information you transmit through such websites is subject to the privacy policies of those websites. It is your responsibility to read their privacy policies to ensure the protection of your Personal Information.

15. CHANGES AND UPDATES TO THE POLICY

Quantum Group may, at its discretion, update, revise, modify, or supplement this Policy from time to time. If a material change is made to the Policy, you will be notified when you log in and/or we will send you a link to the new version of the Policy. The Policy and any related agreements, if any, will be posted on our Website. Quantum Group asks its users to read the updated Policy before continuing to use its services. If you do not accept the updated Policy, you may cancel your account.

In circumstances other than a material change to the Policy, continued use of the services provided by Quantum Group after the amended Policy becomes effective constitutes consent to the amended Policy.

16. HOW TO FILE A COMPLAINT?

Quantum Group has established procedures for receiving complaints and enquiries about its policies and practices relating to the management of Personal Information. Quantum Group will inform individuals who make enquiries or lodge complaints of the existence of the relevant procedures. Quantum Group will investigate all complaints. If a complaint is found to be justified, Quantum Group will take appropriate measures, including, if necessary, amending its policies and practices. If you wish to make a complaint, we invite you to contact us as indicated in the “Contact Us” section. You are also entitled by law to lodge a complaint with a privacy commissioner or any other competent supervisory authority for the protection of Personal Information.

18. DELEGATION OF THE FUNCTION OF PRIVACY OFFICER

The Privacy Officer is the person to whom the President and CEO has delegated the function of ensuring compliance with and implementation of the Act respecting the protection of personal information in the private sector within Quantum Group. It is the Privacy Officer who approves and implements privacy policies and procedures, ensures their proper functioning, and reports to Quantum Group’s senior management on the effectiveness of the program. The Privacy Officer is also responsible for providing you with the necessary support in the event of a question, complaint or request relating to the protection of Personal Information.
